TERMS AND CONDITIONS

CANCELATION POLICY:
Please note that all deposits are non-refundable. If you wish to cancel your booking, you may do so any time up to (and including) the 61st day before the scheduled start date and receive a full refund of any fees above the initial deposit, less an administrative fee of 10% or $100, whichever is greater. If you cancel between 31 and 60 days prior to the start date, you will be charged a cancelation fee of 50% of the retreat or training value, including any deposit you may have paid through Mukti Yoga payment plans. If you cancel your booking less than 31 days prior to the scheduled trip or training start date (or if you fail to show up, or if you leave a trip or training prior to its completion for any reason), then you will not be entitled to any refund. Bookings for all trips are non-transferable. Exceptions to our policy cannot be made for any reason, including weather, hospitalization, business emergencies, personal/family emergencies or personal/family illnesses. There are no discounts for arriving late or leaving the retreat or training early.

Mukti Yoga highly recommends purchasing Travel Protection Insurance when booking your flight to any destination retreat or training. Travel protection insurance is used for any unexpected additional travel expenses that may occur before, during or after your trip.

If Mukti Yoga must cancel any retreat or training for any reason before the scheduled start date, you will receive a complete refund of all monies paid to Mukti Yoga, which shall constitute full settlement of any claims. Mukti Yoga shall not be responsible for any expenses you incurred in preparation for any canceled trips, such as airline tickets, or for costs incurred due to travel delays, flight cancellations or illness, etc.

If you fail to provide personal information and agree to these Terms and Conditions, including “Release of Liability,” “Release and Assumption of All Risks” and “Media Release” in your reservation form prior to your retreat or training start date, you will be deemed to have “cancelled” your reservation and participation in the retreat or training without notice and will not be allowed to participate in the retreat or training. Furthermore, if you refuse to execute copies of the “Release of Liability,” “Release and Assumption of All Risks” and “Media Release” at the commencement of the retreat or training, you will be deemed to have “cancelled” your reservation and participation the retreat or training without notice and will not be allowed to participate in the retreat or training. In such cases, the above-stated cancellation policy will apply.

You understand that you may be terminated from a retreat or training if your behavior is inappropriate or violates the Yoga Alliance ethical guidelines. Under such circumstances you understand that you will not be refunded any portion of your tuition and certification hours will not be granted.

PARTICIPANT AGREEMENT, RELEASE AND ASSUMPTION OF RISK:
Mukti Yoga is dedicated to providing a safe environment for all clients who participate in our retreats and trainings. In consideration of the services of Mukti Yoga, their agents, owners, officers, volunteers, participants, employees, and all other persons or entities acting in any capacity on their behalf, I hereby agree to release, indemnify, and discharge Mukti Yoga, on behalf of myself, my children, my parents, my heirs, assigns, personal representative and estate as follows: (i) I understand that yoga is a form of physical activity and that injuries may occur. (ii) I expressly agree and promise to accept and assume all of the risks existing in this activity. My participation in this activity is purely voluntary, and I elect to participate in spite of the risks. I hereby waive any claim of injury at anytime during the training against Mukti Yoga Teacher Training School and Staff. (iii) I hereby voluntarily release, forever discharge, and agree to indemnify and hold harmless Mukti Yoga from any and all claims, demands, or causes of action, which are in any way connected with my participation in this activity. (iv) Should Mukti Yoga or anyone acting on their behalf, be required to incur attorney’s fees and costs to enforce this agreement, I agree to indemnify and hold them harmless for all such fees and costs. (v) I certify that I have adequate insurance to cover any injury or damage I may cause or suffer while participating, or else I agree to bear the costs of such injury or damage myself. I further certify that I am willing to assume the risk of any medical or physical condition I may have. (vi) In the event that I file a lawsuit against Mukti Yoga, I agree to do so solely in the state of California, and I further agree that the substantive law of that state shall apply in that action without regard to the conflict of law rules of that state. I agree that if any portion of this agreement is found to be void or unenforceable, the remaining portions shall remain in full force and effect. By providing a signature in this reservation form, I acknowledge that if anyone is hurt or property is damaged during my participation in this activity, I may be found by a court of law to have waived my right to maintain a lawsuit against Mukti Yoga on the basis of any claim from which I have released them herein. By providing a signature in this reservation form, the participant, states that he/she: (i) has informed Mukti Yoga, in writing, of any existing conditions that may be affected due to the nature of the program, (ii) is aware of and understands the potential hazards and risks, and (iii) chooses to voluntarily participate. I have had sufficient opportunity to read this entire document. I have read and understood it, and I agree to be bound by its terms.

For Travelers: I understand and assume the risks and hazards inherent in travel. These risks and hazards may include, without limitation, delays, injury, illness, death or other unanticipated events, and may be caused by force majeure events, the negligence of Mukti Yoga or other persons (including third party operators), the intentional and/or criminal conduct of others or other circumstances. Certain locations are remote and require additional travel time away from city centers and towns; as such, medical attention may not always be readily available or may be of inferior quality compared to what is available at home. Also, I may be visiting places where the political, cultural and geographical environment is very different than where I live, and in some cases, these differences may present increased risks and/or challenges. Mukti Yoga uses reasonably available information from the U.S. government, applicable foreign governments and reports from our contacts in planning each trip itinerary, and assessing the viability of each trip itinerary as the start date approaches. However, it is my responsibility to acquaint myself with all available and relevant travel information for my destination and the nature of my itinerary. I acknowledge and agree that my decision to travel is made after having considered this information, and I expressly assume the personal risks involved with such travel.

RELEASE OF LIABILITY:
I acknowledge and agree that Mukti Yoga and its faculty, staff, administrators, trustees, and employees shall not be liable for any direct, indirect, consequential or incidental damage, liability, injury, loss, cost or expense I may incur (including any claim relating to personal injury, illness, death, property damage or loss, delay or other inconvenience) arising out of or by reason of (i) the acts or omissions of any Third Party Operator or (ii) the negligence of any of the Mukti Yoga Parties or (iii) any acts or omissions of any other parties or (iv) force majeure events.

I release and discharge Mukti Yoga, its faculty, staff, administrators, trustees, and employees from any and all claims, liabilities, losses, expenses, damages, demands, actions, causes of action, lawsuits or sums of money of any kind arising out of, by reason of, resulting from and/or related to any retreat or training I may book and/or participate in; and I understand and acknowledge that I am fully responsible for and expressly assume any and all risks, present and future, whether known or unknown,  and resulting from my participation in any Mukti Yoga retreat and/or training.

MEDIA RELEASE FORM:
I acknowledge that I may be photographed or video taped and displayed in any form or manner, including but not limited to; books, displays, publications, newspapers, advertisements, website, press releases, articles, promotions, promotional video, etc. This footage may also be released to Mukti Yoga affiliates and displayed in any form or manner, including but not limited to; books, displays, publications, newspapers, advertisements, website, press releases, articles, promotions, promotional video, etc. Your signature on your reservation form below releases all liability from Mukti Yoga, including independent contractors, staff members, accommodations location, outside vendors and Mukti Yoga Owners.

IMMUNIZATIONS AND TRAVEL ADVISORIES/WARNINGS:
Each client assumes full responsibility for verifying any requirements relating to and/or obtaining any immunizations which may be necessary or desirable for travel in the applicable country(ies) and/or region(s). Each client also assumes full responsibility for researching the safety and security conditions in the applicable country(ies) and/or region(s) during the period of scheduled travel, and being aware of any applicable travel advisories and/or warnings. Clients may also wish to consult a physician who is knowledgeable about travel medicine and related medical issues in the country(ies) and/or region(s) to be visited.

ARBITRATION:
I agree that any dispute relating to my booking, the Traveler Terms & Conditions, the Agreement or any other issues relating to my trip (including any claim I may wish to assert relating to or arising out of my trip) shall be referred to confidential and binding arbitration in Los Angeles, California, by a single arbitrator pursuant to the AAA streamlined rules.  Any arbitration award shall be rendered in writing and may be entered and shall be fully enforceable as a judgment in any court of competent jurisdiction. The parties expressly waive their right to trial, including trial by jury. Each party shall bear its own attorneys’ fees and costs.

PROPERTY OF MUKTI YOGA:
I understand that all information provided in the Mukti Yoga Teacher Training Manual is not to be reproduced without Mukti Yoga’s consent.

TRAINING ATTENDANCE AND MAKE UP POLICY:
Attendance Policy
200-hour Foundation Training:
No more than 20 in-class contact hours may be missed for students to receive full 200 hours of Foundation teacher training credit.

Missing more than 15 (and less than 20) in-class contact hours necessitates the student pay an additional flat rate fee of $155 per hour for a private (or group) make up training session(s) with the Senior Teacher(s).

100-hour Graduate or Prenatal Training:
No more than 10 in-class contact hours may be missed for students to receive full 100 hours of Graduate or Prenatal teacher training credit.

Missing more than 7 (and less than 10) in-class contact hours necessitates the student pay an additional flat rate fee of $155 per hour for a private (or group) make up training session(s) with the Senior Teacher(s).

50-hour Module:
No more than 5 in-class contact hours may be missed for students to receive full 50 hours of elective module teacher training credit.

Missing more than 3 (and less than 5) in-class contact hours necessitates the student pay an additional flat rate fee of $155 per hour for a private (or group) make up training session(s) with the teacher(s).

Make Up Policy
Make up training sessions can be up to 5 hours long and lead by a Senior Teacher. The make up training session(s) will be equivalent to no more than 5 contact training hours.

When a student misses less than 15 hours of a Foundation training, 7 hours of a Graduate or Prenatal training or 3 hours of a Module, the following are adequate means of recovering missed in-class contact hours:

  • Assisting a class by the Senior Teacher or another Senior Mukti Yoga Teacher
  • Class observation with written critique submitted to the Senior Teacher (this does not have to be a Mukti Yoga Teacher’s class)
  • Students must demonstrate knowledge of missed information by submitting a written review of the missed information to the Senior Teacher

*Any Mukti Senior Teacher may lead these make up training sessions

CERTIFICATION:
Your certification is dependent on fully completing (including any make-up sessions, if required, as stated in our attendance policy) and paying for your registered teacher training. You understand that you may be terminated from a training if your behavior is inappropriate or violates the Yoga Alliance ethical guidelines. Under such circumstances you understand that you will not be refunded any portion of your tuition and certification hours will not be granted.
